Liability Waiver
Acknowledgment of Risk
I, the undersigned participant, acknowledge and understand that attending this baking/cooking class involves participation in various kitchen activities that could result in injury, including but not limited to the use of knives, hot surfaces, ovens, induction cooktops, and other kitchen equipment. I am aware that these activities may involve risks such as cuts, burns, and other injuries, and I voluntarily assume all risks associated with my participation.
Medical Disclosure
I affirm that I am in good physical health and do not have any medical conditions that would prevent my participation in this class. I have disclosed any relevant health concerns to the instructor and understand that it is my responsibility to consult with a physician before participating if I have any doubts about my ability to engage in these activities.
Food Allergies and Dietary Restrictions
I acknowledge that it is my responsibility to inform the instructor of any food allergies or dietary restrictions I may have before the class begins. I understand that NY Cake Academy LLC, Cake Supplies LLC, and any affiliated companies cannot guarantee an allergen-free environment.
Release of Liability
In consideration of being allowed to participate in this baking/cooking class, I hereby release, waive, discharge, and hold harmless NY Cake Academy LLC, Cake Supplies LLC, and any affiliated companies, along with their instructors, agents, employees, and volunteers from any and all liability for any injuries, losses, or damages arising out of or related to my participation in this class, whether caused by negligence or otherwise.
Indemnification
I agree to indemnify and hold harmless NY Cake Academy LLC, Cake Supplies LLC, and any affiliated companies from any and all claims, actions, damages, or liabilities that may arise from my participation in this class, including those arising from my own negligence.
Emergency Medical Treatment
In the event of an emergency, I authorize NY Cake Academy LLC to secure medical treatment for me, and I agree to be responsible for any costs associated with such treatment.
Photography/Video Release
I grant permission for NY Cake Academy LLC and Cake Supplies LLC to take photographs and/or videos of me during the class, and to use these images for promotional and marketing purposes.
Acknowledgment of Understanding
I have read this Participation Liability Waiver and fully understand its terms.
PHOTO RELEASE
NY Cake Academy will, from time to time, photograph, video, or otherwise record classes or events.
By registering and/or attending a class or event, students consent to the recording and use of photo and video content for use on NY Cake Academy's website, social media platforms, and other marketing materials.
NY CAKE ACADEMY CLASSES
NY Cake Academy Classes are not eligible for refunds, however classes are transferrable.
All Bookings receive a confirmation immediately after booking. Please notify custom@nycakeacadeny.com if you do not receive a confirmation email. Students are responsible to ensure they receive and read their confirmation email. All supplies are included unless stated in the class description.
If you would like to change a class date, you may do so by emailing custom@nycakeacademy.com 48 hours in advance. Please be sure to include the full name of the registered student, class confirmation number and class you wish to transfer into. If we do not receive an email from you stating you cannot make the class, your payment is forfeited. There is a 1 time courtesy makeup of a missed class. Please be sure you can make the new date and time before requesting a switch. If you do not show up to your makeup class, your tuition is forfeited.
If a class is canceled due to low enrollment, inclement weather or another circumstance beyond our control (power outage, facility issues, etc), we will contact you with as much advance notice as possible by email or telephone and issue you a refund to the original form of payment.
We will make every effort to run the class as long as it is safe to do so. If we make the decision to run the class and you decide not to come, you will not be able to get a refund, but we will offer you a credit for future use valid for 1 year.
CUSTOM IMAGE, CAKE & COOKIE ORDERS
Once you place a custom order, you will get a confirmation of your order. We will make your custom order and you are responsible for picking up your order on the date you selected.
Orders left on our premises that were never picked up, will forfeit the money paid for the order.
No refunds or credits will be issued.
PRIVATE EVENTS & BIRTHDAY PARTIES
A 50% deposit is required to secure an event/party at NY Cake. Once deposits are made, date changes are not allowed. A date change would require a new booking and your old deposit would be forfeited.
If NY Cake Academy decides to cancel an event due to inclement weather or forces beyond our control (power outage, facility issues, etc), we will contact you with as much advance notice as possible and offer you a new date for your event.
